Welcome to Emilia Genova. These Terms of Service (“Terms”) govern the use of our website and the purchase of garments (“Products”) from us. By accessing the website or placing an order, you agree to these Terms.

2. Eligibility & Access
To purchase Products on our Website, you must be at least 18 years old and legally capable of entering into binding contracts in your jurisdiction.
3. Product Categories: Standard Size & Made-to-Measure
We distinguish between two types of garments:
(a) “Standard Size Garments” = garments produced in our standard size range (e.g. XS–XL).
(b) “Made-to-Measure Garments” = garments produced based on customer-provided measurements or specifications.
4. Made-to-Measure: Final Sale & Alteration Policy
Made-to-measure garments are produced individually to your specifications and are therefore final sale. They are not eligible for cancellation, return, exchange, or refund except in the case of confirmed defect.
Complimentary alterations may be offered within reasonable limits for fit adjustments. Alterations do not include redesigns, silhouette changes, or significant pattern modifications.
We are not liable for measurement inaccuracies provided by the customer.
5. Standard Size Garments & Return Eligibility
Standard size garments may be eligible for return as detailed in our Return & Refund Policy, provided they are unworn, unwashed, undamaged, and in original condition with all tags and packaging intact.
6. Production & Atelier Lead Times
All garments are produced individually upon order. Please allow up to 3 weeks for production before dispatch. Production time does not include transit time.
Lead times may vary based on volume, atelier schedules, or material availability.
7. Event Deadlines & Time-Sensitive Orders
We cannot guarantee delivery for specific events, travel, or occasions unless expressly confirmed in writing prior to purchase. Missed event deadlines do not constitute grounds for cancellation, return, or refund.
8. Pricing, Duties & Taxes
Prices are displayed in the currency determined by your region.
For customers within the European Union, displayed prices include applicable VAT.
For customers in the United States, United Kingdom, or other selected international markets, duties and import taxes may be collected at checkout (DDP) when available. Where DDP is not available, duties may be due upon delivery.
Duties and taxes are non-refundable in the event of a return.
9. Shipping & Delivery Terms
Shipping destinations, costs, transit times, and duty handling are detailed in our Shipping & Duties Policy.
Risk of loss transfers to the customer once the parcel is handed to the carrier. We are not responsible for delays caused by the carrier, customs authorities, or force majeure.
10. Payment & Transaction Security
We accept the following payment methods:
– Credit/Debit Cards (via Shopify Payments / Stripe)
– Shop Pay
– Apple Pay
– PayPal
Payment is processed upon order placement. By submitting payment information, you confirm that you have the right to use the chosen method.
11. Returns, Defects & Warranty Rights
Returns are only accepted for standard size garments in accordance with our Return & Refund Policy.
Made-to-measure garments are final sale.
If you believe your garment is defective or incorrect, you must notify us within 72 hours of delivery with supporting photographs for assessment. If confirmed, we will offer repair, replacement, or refund at our discretion.
12. Intellectual Property & Usage Restrictions
All garment designs, patterns, images, text, and trademarks are the property of Emilia Genova and may not be reproduced or distributed without written consent.
Commercial resale of Products without authorization is prohibited.
13. Privacy & Data Protection
We process personal data in accordance with our Privacy & Cookies Policy. By using the Website or placing an order, you consent to such processing.
14. Governing Law & Jurisdiction
These Terms and any disputes arising from them shall be governed by the laws of Bulgaria. The courts of Sofia, Bulgaria shall have exclusive jurisdiction.
15. Liability Limitations
To the fullest extent permitted by law, we shall not be liable for indirect, consequential, or incidental damages including loss of profits, missed events, or loss of opportunity. Nothing in these Terms excludes liability where prohibited by law.
16. Amendments to Terms
We may update these Terms occasionally. Updated Terms will be posted with a revised “Last updated” date. Continued use of the Website constitutes acceptance of updated Terms.
